1. Who we are
These Terms of Service ("Terms") are a binding agreement between you and EssayMark ("EssayMark", "we", "us", or "our"), the operator of the EssayMark service available at this website (the "Service").
2. Acceptance
By creating an account, submitting an essay, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
3. The Service
EssayMark provides automated, AI-assisted feedback on user-submitted essay responses. The Service is provided "as is" and "as available" without warranty of any kind. Grades and feedback are estimates produced by large language models and should not be relied on as predictive of actual CFA exam scoring. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
4. Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Paid subscriptions auto-renew at the then-current price until canceled. You may cancel at any time from your Account page; cancellation takes effect at the end of the current billing period. See our Refund Policy for refund details.
5. Acceptable use
You agree not to misuse the Service. You must not: (a) use the Service for any unlawful purpose; (b) submit content you do not have the right to use; (c) attempt to probe, scan, scrape, or interfere with the Service's security or infrastructure; (d) upload malware or attempt to circumvent usage limits, rate limits, or paywalls; (e) infringe any third-party intellectual property rights; or (f) use the Service to generate, distribute, or facilitate spam, fraud, harassment, or illegal content.
6. Accounts
You are responsible for safeguarding your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.
7. Intellectual property
EssayMark retains all right, title, and interest in the Service, including software, documentation, branding, and all related intellectual property. You retain ownership of the essay content you submit; you grant EssayMark a limited, worldwide, royalty-free license to host, process, and transmit your submissions solely to provide the Service to you (including sending them to AI model providers to generate your grading report).
8. AI outputs and disclaimer
AI-generated outputs may contain inaccuracies. They are provided for educational purposes only and are not a substitute for professional advice or for the official CFA Institute examination. You are responsible for how you use, share, or rely on outputs.
9. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have: (a) materially breached these Terms; (b) failed to pay amounts due; (c) created a security, fraud, or legal risk for EssayMark or other users; or (d) repeatedly or seriously violated our acceptable use rules. You may stop using the Service at any time by canceling your subscription and deleting your account.
10. Limitation of liability
To the fullest extent permitted by law, EssayMark's aggregate liability arising out of or related to the Service will not exceed the fees you paid to us in the twelve months preceding the claim. EssayMark will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
11. Trademarks
CFA® and Chartered Financial Analyst® are trademarks owned by CFA Institute. EssayMark is not affiliated with, endorsed by, or sponsored by CFA Institute.
12. Changes
We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, by email.
